What Is a Marriage Dissolution in North Carolina?

Marriage dissolution in North Carolina is known as an absolute divorce. This legal process fully terminates the marital relationship, leaving both parties free to remarry if they choose. It does not undo the marriage as though it never existed, but it provides a clear and formal conclusion to the partnership. The time period prior to filing for an absolute divorce may also pave the way for resolving related issues such as child custody, child support, property division and spousal support.

Navigating the dissolution process alone can feel overwhelming. That’s why having the right attorney by your side is crucial. An experienced lawyer can help you understand the legal procedures and ensure that your rights and interests are protected throughout the process.

How to Obtain a Marriage Dissolution in North Carolina

To obtain a marriage dissolution in North Carolina, specific eligibility criteria must be met. Firstly, at least one spouse must have lived in the state for at least six months prior to filing for divorce. Secondly, the couple must have lived separately and apart for a minimum of one continuous year with the intent of not reconciling.

The process begins by filing a complaint for absolute divorce in the appropriate county courthouse. This document provides essential information such as the names of both spouses, the date and place of marriage, and confirmation of the one-year separation requirement. Along with the complaint, other supporting documents may be required and the filing party (the plaintiff) must serve these papers to their spouse (the defendant).

The Dissolution Process in North Carolina

After the complaint has been served, the defendant has 30 days to respond. Prior to filing for an absolute divorce, legal negotiations may begin in order to address related issues like division of marital property or child custody. In order to properly effectuate a full and final settlement, both parties must provide full financial disclosures to ensure transparency. Some cases are resolved through mediation or negotiation, minimizing the need for court involvement. If an agreement cannot be reached, the matter may go to trial.

Once the court has reviewed all pleadings and necessary agreements, it will issue a final judgment and decree of divorce. This document outlines the court’s decisions regarding the marriage dissolution and can incorporate any Agreement executed by the parties which will make the Agreement a Court Order. The marriage is officially dissolved the day the judge signs this decree, and a certificate of divorce is remitted to vital records for recording.
